The BRANA was formed in 2010 as an advocacy organization with a primary mission of closely working with the United States Government, Canadian Government, and various NGOs in legislation, policy formulation, and humanitarian support for issues facing the Rohingya people in Burma and other countries around the world. The BRANA is actively engaged with United States Senate, House of Representatives, and the State Department to facilitate the legislative and other processes in Washington, D.C., for the welfare of Rohingya people worldwide, Rohingya living in their native Burma, and those residing in North America.Additionally BRANA maintains strong ties with various NGOs around the world to advance the cause of Rohingya. BRANA also serves as the facilitator in the process its members in their communication with the congressional offices of their constituency to work on their behalf on international and domestic issues that concern Rohingya. OIC, Foreign Ministers To Visit Myanmar To Discuss Rohingya Muslims' Plight

KUALA LUMPUR, Nov 21 (Bernama) -- The Organisation of Islamic Cooperation (OIC) is in the midst of arranging a visit to Myanmar for discussion on ways to resolve the crisis faced by minority Rohingya Muslims.

According to OIC, the visit will be led by Secretary-General Ekmeleddin Ihsanoglu, and a number of foreign ministers from the member states.

The ministers will assess the humanitarian needs of those affected by the violence in the Rakhine state, and also coordinate with the Myanmar authorities to develop a plan for it, it said in a statement.

The visit is part of the resolutions adopted at the recent OIC Council of Foreign Ministers (CFM) meeting in Djibouti.

The 39th CFM urged member states to intensify efforts in the restoration of the Rohingya Muslims' nationality and citizenship rights, and the return of refugees, as soon as possible.

Rohingya Americans Praise Obama’s Speech




WASHINGTON—The Rohingya community in the United States on Monday welcomed US President Barack Obama’s speech in Rangoon and, along with other Burmese communities and rights bodies, urged him not to ignore human rights issues in the country.

Rohingya Americans especially appreciated Obama’s remarks that “there’s no excuse for violence against innocent people, and the Rohingya hold within themselves the same dignity as you do, and I do.”

“The words in your speech today have cured the minds and thoughts of millions of Burmese infected by Gen Ne Win’s philosophy of Burman and Buddhism as the only superior race and religion,” said Nay San Oo, co-founder of the Free Rohingya Campaign.

But the Burma Task Force said that it was “shocked” at the timing of the president’s visit. “President Obama chose to visit when Burmese nationalist resentment and discrimination continue to target ethnic minorities, especially the Rohingya people, with thousands of homes destroyed in Burma’s Rakhine [Arakan] State, hundreds of people killed and tens of thousands displaced within the last month alone,” it said in a statement.

The recent communal violence between Arakanese Buddhists and Rohingya Muslims which has engulfed western Burma since June has so far killed at least 180 people, destroyed thousands of homes and displaced more than 110,000 people, according to official figures.

Signed by more than half-a-dozen rights bodies including the American Society for Muslim Advancement, Burmese Rohingya Association of North America, Interfaith Center of New York and Free Rohingya Campaign, the statement said the US should not ignore state-sponsored persecution of ethnic and religious minorities but instead energetically support rights for all peoples living in Burma.

“A viable US foreign policy must be based on human rights recognition and protection. Let there be no mistake,” said the statement. “In the president’s speech today, Mr. Obama spoke eloquently of democracy and human dignity and at last made reference to the Rohingya’s right to dignity and the need for reconciliation.

“However, his remarks about local insurgencies were unclear and leave us troubled about our government’s commitment to advocate for those most victimized,” added the statement. “We wonder: Will this administration follow up effectively to confront the pogrom against minorities and the exclusionary government policies that encourage division and hate in Burma?”

Obama’s trip marked the very first time that a sitting US president had visited Burma, and came less than two weeks after he defeated Republican rival Mitt Romney at the ballot box to win a second term in the White House.

Meanwhile, the Institute for Science and International Security (ISIS) welcomed Burma’s decision to sign “additional protocol” that would allow the International Atomic Energy Agency (IAEA) to more efficiently and effectively provide assurance regarding the absence of undeclared nuclear materials and activities in Burma.

“This latest move by Burma is extremely positive for its ongoing push for openness about the nuclear issue and for building confidence and transparency with the international community,” said a ISIS report authored by David Albright and Andrea Stricker.

“As part of the process of implementing the additional protocol, Burma should answer questions the IAEA has about any past nuclear activities and the procurement of sensitive equipment possibly used or intended for nuclear purposes.”

Burma’s former military junta had previously been accused of attempting to procure nuclear technology from North Korea.

Rangoon, Burma
PRESIDENT OBAMA: Thank you. (Applause.) Myanmar Naingan, Mingalaba! (Laughter and applause.) I am very honored to be here at this university and to be the first President of the United States of America to visit your country.

I came here because of the importance of your country. You live at the crossroads of East and South Asia. You border the most populated nations on the planet. You have a history that reaches back thousands of years, and the ability to help determine the destiny of the fastest growing region of the world.

I came here because of the beauty and diversity of your country. I have seen just earlier today the golden stupa of Shwedagon, and have been moved by the timeless idea of metta — the belief that our time on this Earth can be defined by tolerance and by love. And I know this land reaches from the crowded neighborhoods of this old city to the homes of more than 60,000 villages; from the peaks of the Himalayas, the forests of Karen State, to the banks of the Irrawady River.

I came here because of my respect for this university. It was here at this school where opposition to colonial rule first took hold. It was here that Aung San edited a magazine before leading an independence movement. It was here that U Thant learned the ways of the world before guiding it at the United Nations. Here, scholarship thrived during the last century and students demanded their basic human rights. Now, your Parliament has at last passed a resolution to revitalize this university and it must reclaim its greatness, because the future of this country will be determined by the education of its youth.

I came here because of the history between our two countries. A century ago, American traders, merchants and missionaries came here to build bonds of faith and commerce and friendship. And from within these borders in World War II, our pilots flew into China and many of our troops gave their lives. Both of our nations emerged from the British Empire, and the United States was among the first countries to recognize an independent Union of Burma. We were proud to found an American Center in Rangoon and to build exchanges with schools like this one. And through decades of differences, Americans have been united in their affection for this country and its people.

Above all, I came here because of America’s belief in human dignity. Over the last several decades, our two countries became strangers. But today, I can tell you that we always remained hopeful about the people of this country, about you. You gave us hope and we bore witness to your courage.

We saw the activists dressed in white visit the families of political prisoners on Sundays and monks dressed in saffron protesting peacefully in the streets. We learned of ordinary people who organized relief teams to respond to a cyclone, and heard the voices of students and the beats of hip-hop artists projecting the sound of freedom. We came to know exiles and refugees who never lost touch with their families or their ancestral home. And we were inspired by the fierce dignity of Daw Aung San Suu Kyi, as she proved that no human being can truly be imprisoned if hope burns in your heart.

When I took office as President, I sent a message to those governments who ruled by fear. I said, in my inauguration address, “We will extend a hand if you are willing to unclench your fist.” And over the last year and a half, a dramatic transition has begun, as a dictatorship of five decades has loosened its grip. Under President Thein Sein, the desire for change has been met by an agenda for reform. A civilian now leads the government, and a parliament is asserting itself. The once-outlawed National League for Democracy stood in an election, and Aung San Suu Kyi is a Member of Parliament. Hundreds of prisoners of conscience have been released, and forced labor has been banned. Preliminary cease-fires have been reached with ethnic armies, and new laws allow for a more open economy.

So today, I’ve come to keep my promise and extend the hand of friendship. America now has an Ambassador in Rangoon, sanctions have been eased, and we will help rebuild an economy that can offer opportunity for its people, and serve as an engine of growth for the world. But this remarkable journey has just begun, and has much further to go. Reforms launched from the top of society must meet the aspirations of citizens who form its foundation. The flickers of progress that we have seen must not be extinguished — they must be strengthened; they must become a shining North Star for all this nation’s people.

And your success in that effort is important to the United States, as well as to me. Even though we come from different places, we share common dreams: to choose our leaders; to live together in peace; to get an education and make a good living; to love our families and our communities. That’s why freedom is not an abstract idea; freedom is the very thing that makes human progress possible — not just at the ballot box, but in our daily lives.

One of our greatest Presidents in the United States, Franklin Delano Roosevelt, understood this truth. He defined America’s cause as more than the right to cast a ballot. He understood democracy was not just voting. He called upon the world to embrace four fundamental freedoms: freedom of speech, freedom of worship, freedom from want, and freedom from fear. These four freedoms reinforce one another, and you cannot fully realize one without realizing them all.

So that’s the future that we seek for ourselves, and for all people. And that is what I want to speak to you about today.

First, we believe in the right of free expression so that the voices of ordinary people can be heard, and governments reflect their will — the people’s will.

In the United States, for more than two centuries, we have worked to keep this promise for all of our citizens — to win freedom for those who were enslaved; to extend the right to vote for women and African Americans; to protect the rights of workers to organize.

And we recognize no two nations achieve these rights in exactly the same way, but there is no question that your country will be stronger if it draws on the strength of all of its people. That’s what allows nations to succeed. That’s what reform has begun to do.

Instead of being repressed, the right of people to assemble together must now be fully respected. Instead of being stifled, the veil of media censorship must continue to be lifted. And as you take these steps, you can draw on your progress. Instead of being ignored, citizens who protested the construction of the Myitsone dam were heard. Instead of being outlawed, political parties have been allowed to participate. You can see progress being made. As one voter said during the parliamentary elections here, “Our parents and grandparents waited for this, but never saw it.” And now you can see it. You can taste freedom.

And to protect the freedom of all the voters, those in power must accept constraints. That’s what our American system is designed to do. Now, America may have the strongest military in the world, but it must submit to civilian control. I, as the President of the United States, make determinations that the military then carries out, not the other way around. As President and Commander-In-Chief, I have that responsibility because I’m accountable to the people.

Now, on other hand, as President, I cannot just impose my will on Congress — the Congress of the United States — even though sometimes I wish I could. The legislative branch has its own powers and its own prerogatives, and so they check my power and balance my power. I appoint some of our judges, but I cannot tell them how to rule, because every person in America — from a child living in poverty to me, the President of the United States — is equal under the law. And a judge can make a determination as to whether or not I am upholding the law or breaking the law. And I am fully accountable to that law.

And I describe our system in the United States because that’s how you must reach for the future that you deserve — a future where a single prisoner of conscience is one too many. You need to reach for a future where the law is stronger than any single leader, because it’s accountable to the people. You need to reach for a future where no child is made to be a soldier and no woman is exploited, and where the laws protect them even if they’re vulnerable, even if they’re weak; a future where national security is strengthened by a military that serves under civilians and a Constitution that guarantees that only those who are elected by the people may govern.

On that journey, America will support you every step of the way — by using our assistance to empower civil society; by engaging your military to promote professionalism and human rights; and by partnering with you as you connect your progress towards democracy with economic development. So advancing that journey will help you pursue a second freedom — the belief that all people should be free from want.

It’s not enough to trade a prison of powerlessness for the pain of an empty stomach. But history shows that governments of the people and by the people and for the people are far more powerful in delivering prosperity. And that’s the partnership we seek with you.

When ordinary people have a say in their own future, then your land can’t just be taken away from you. And that’s why reforms must ensure that the people of this nation can have that most fundamental of possessions — the right to own the title to the land on which you live and on which you work.

When your talents are unleashed, then opportunity will be created for all people. America is lifting our ban on companies doing business here, and your government has lifted restrictions on investment and taken steps to open up your economy. And now, as more wealth flows into your borders, we hope and expect that it will lift up more people. It can’t just help folks at the top. It has to help everybody. And that kind of economic growth, where everybody has opportunity — if you work hard, you can succeed — that’s what gets a nation moving rapidly when it comes to develop.

But that kind of growth can only be created if corruption is left behind. For investment to lead to opportunity, reform must promote budgets that are transparent and industry that is privately owned.

To lead by example, America now insists that our companies meet high standards of openness and transparency if they’re doing business here. And we’ll work with organizations like the World Bank to support small businesses and to promote an economy that allows entrepreneurs, small businesspeople to thrive and allows workers to keep what they earn. And I very much welcome your government’s recent decision to join what we’ve called our Open Government Partnership, so that citizens can come to expect accountability and learn exactly how monies are spent and how your system of government operates.

Above all, when your voices are heard in government, it’s far more likely that your basic needs will be met. And that’s why reform must reach the daily lives of those who are hungry and those who are ill, and those who live without electricity or water. And here, too, America will do our part in working with you.

Today, I was proud to reestablish our USAID mission in this country, which is our lead development agency. And the United States wants to be a partner in helping this country, which used to be the rice bowl of Asia, to reestablish its capacity to feed its people and to care for its sick, and educate its children, and build its democratic institutions as you continue down the path of reform.

This country is famous for its natural resources, and they must be protected against exploitation. And let us remember that in a global economy, a country’s greatest resource is its people. So by investing in you, this nation can open the door for far more prosperity — because unlocking a nation’s potential depends on empowering all its people, especially its young people.

Just as education is the key to America’s future, it is going to the be the key to your future as well. And so we look forward to working with you, as we have with many of your neighbors, to extend that opportunity and to deepen exchanges among our students. We want students from this country to travel to the United States and learn from us, and we want U.S. students to come here and learn from you.

And this truth leads me to the third freedom that I want to discuss: the freedom to worship — the freedom to worship as you please, and your right to basic human dignity.

This country, like my own country, is blessed with diversity. Not everybody looks the same. Not everybody comes from the same region. Not everybody worships in the same way. In your cities and towns, there are pagodas and temples, and mosques and churches standing side by side. Well over a hundred ethnic groups have been a part of your story. Yet within these borders, we’ve seen some of the world’s longest running insurgencies, which have cost countless lives, and torn families and communities apart, and stood in the way of development.

No process of reform will succeed without national reconciliation. (Applause.) You now have a moment of remarkable opportunity to transform cease-fires into lasting settlements, and to pursue peace where conflicts still linger, including in Kachin State. Those efforts must lead to a more just and lasting peace, including humanitarian access to those in need, and a chance for the displaced to return home.

Today, we look at the recent violence in Rakhine State that has caused so much suffering, and we see the danger of continued tensions there. For too long, the people of this state, including ethnic Rakhine, have faced crushing poverty and persecution. But there is no excuse for violence against innocent people. And the Rohingya hold themselves — hold within themselves the same dignity as you do, and I do.

National reconciliation will take time, but for the sake of our common humanity, and for the sake of this country’s future, it is necessary to stop incitement and to stop violence. And I welcome the government’s commitment to address the issues of injustice and accountability, and humanitarian access and citizenship. That’s a vision that the world will support as you move forward.

Every nation struggles to define citizenship. America has had great debates about these issues, and those debates continue to this day, because we’re a nation of immigrants — people coming from every different part of the world. But what we’ve learned in the United States is that there are certain principles that are universal, apply to everybody no matter what you look like, no matter where you come from, no matter what religion you practice. The right of people to live without the threat that their families may be harmed or their homes may be burned simply because of who they are or where they come from.

Only the people of this country ultimately can define your union, can define what it means to be a citizen of this country. But I have confidence that as you do that you can draw on this diversity as a strength and not a weakness. Your country will be stronger because of many different cultures, but you have to seize that opportunity. You have to recognize that strength.

I say this because my own country and my own life have taught me the power of diversity. The United States of America is a nation of Christians and Jews, and Muslims and Buddhists, and Hindus and non-believers. Our story is shaped by every language; it’s enriched by every culture. We have people from every corners of the world. We’ve tasted the bitterness of civil war and segregation, but our history shows us that hatred in the human heart can recede; that the lines between races and tribes fade away. And what’s left is a simple truth: e pluribus unum — that’s what we say in America. Out of many, we are one nation and we are one people. And that truth has, time and again, made our union stronger. It has made our country stronger. It’s part of what has made America great.

We amended our Constitution to extend the democratic principles that we hold dear. And I stand before you today as President of the most powerful nation on Earth, but recognizing that once the color of my skin would have denied me the right to vote. And so that should give you some sense that if our country can transcend its differences, then yours can, too. Every human being within these borders is a part of your nation’s story, and you should embrace that. That’s not a source of weakness, that’s a source of strength — if you recognize it.

And that brings me to the final freedom that I will discuss today, and that is the right of all people to live free from fear.

In many ways, fear is the force that stands between human beings and their dreams. Fear of conflict and the weapons of war. Fear of a future that is different from the past. Fear of changes that are reordering our societies and economy. Fear of people who look different, or come from a different place, or worship in a different way. In some of her darkest moments, when Aung San Suu Kyi was imprisoned, she wrote an essay about freedom from fear. She said fear of losing corrupts those who wield it — “Fear of losing power corrupts those who wield it, and fear of the scourge of power corrupts those who are subject to it.”

That’s the fear that you can leave behind. We see that chance in leaders who are beginning to understand that power comes from appealing to people’s hopes, not people’s fears. We see it in citizens who insist that this time must be different, that this time change will come and will continue. As Aung San Suu Kyi wrote: “Fear is not the natural state of civilized man.” I believe that. And today, you are showing the world that fear does not have to be the natural state of life in this country.

That’s why I am here. That’s why I came to Rangoon. And that’s why what happens here is so important — not only to this region, but to the world. Because you’re taking a journey that has the potential to inspire so many people. This is a test of whether a country can transition to a better place.

The United States of America is a Pacific nation, and we see our future as bound to those nations and peoples to our West. And as our economy recovers, this is where we believe we will find enormous growth. As we have ended the wars that have dominated our foreign policy for a decade, this region will be a focus for our efforts to build a prosperous peace.

Here in Southeast Asia, we see the potential for integration among nations and people. And as President, I have embraced ASEAN for reasons that go beyond the fact that I spent some of my childhood in this region, in Indonesia. Because with ASEAN, we see nations that are on the move — nations that are growing, and democracies that are emerging; governments that are cooperating; progress that’s building on the diversity that spans oceans and islands and jungles and cities, peoples of every race and every religion. This is what the 21st century should look like if we have the courage to put aside our differences and move forward with a sense of mutual interest and mutual respect.

And here in Rangoon, I want to send a message across Asia: We don’t need to be defined by the prisons of the past. We need to look forward to the future. To the leadership of North Korea, I have offered a choice: let go of your nuclear weapons and choose the path of peace and progress. If you do, you will find an extended hand from the United States of America.

In 2012, we don’t need to cling to the divisions of East, West and North and South. We welcome the peaceful rise of China, your neighbor to the North; and India, your neighbor to the West. The United Nations — the United States will work with any nation, large or small, that will contribute to a world that is more peaceful and more prosperous, and more just and more free. And the United States will be a friend to any nation that respects the rights of its citizens and the responsibilities of international law.

That’s the nation, that’s the world that you can start to build here in this historic city. This nation that’s been so isolated can show the world the power of a new beginning, and demonstrate once again that the journey to democracy goes hand in hand with development. I say this knowing that there are still countless people in this country who do not enjoy the opportunities that many of you seated here do. There are tens of millions who have no electricity. There are prisoners of conscience who still await release. There are refugees and displaced peoples in camps where hope is still something that lies on the distant horizon.

Today, I say to you — and I say to everybody that can hear my voice — that the United States of America is with you, including those who have been forgotten, those who are dispossessed, those who are ostracized, those who are poor. We carry your story in our heads and your hopes in our hearts, because in this 21st century with the spread of technology and the breaking down of barriers, the frontlines of freedom are within nations and individuals, not simply between them.

As one former prisoner put it in speaking to his fellow citizens, “Politics is your job. It’s not only for [the] politicians.” And we have an expression in the United States that the most important office in a democracy is the office of citizen — not President, not Speaker, but citizen. (Applause.)

So as extraordinary and difficult and challenging and sometimes frustrating as this journey may seem, in the end, you, the citizens of this country, are the ones who must define what freedom means. You’re the ones who are going to have to seize freedom, because a true revolution of the spirit begins in each of our hearts. It requires the kind of courage that so many of your leaders have already displayed.

The road ahead will be marked by huge challenges, and there will be those who resist the forces of change. But I stand here with confidence that something is happening in this country that cannot be reversed, and the will of the people can lift up this nation and set a great example for the world. And you will have in the United States of America a partner on that long journey. So, cezu tin bad de. (Applause.)

FINDINGS: The Burmese military is implicated in some of the world‘s worst human rights abuses, including rape, torture, ethnic cleansing, conscription of child soldiers, and particularly severe religious freedom violations. These abuses continued in the past reporting period, despite November 2010 elections that installed a new government and some initial reforms announced during 2011-2012. Religious groups, particularly ethnic minority Christians and Muslims and Buddhist monks suspected of engaging in antigovernment activity, faced intrusive monitoring, arrest, mistreatment, destruction or desecration of property, severe restrictions on worship, education, and religious activities, and targeted violence. Monks are still imprisoned for participating in peaceful demonstrations in 2007, and the ban on independent Protestant ―house church‖ activities remains. 

In light of these continued systematic, ongoing, and egregious violations, USCIRF again recommends in 2012 that Burma be designated as a ―country of particular concern‖ (CPC). The State Department has designated Burma as a CPC since 1999. 

Religious freedom violations affect every religious group in Burma. Although the new government has released prominent leaders of the 2007 demonstrations, Buddhist monks suspected of anti-government activities have been detained in the past year. Most of the recent releases were conditional. U Gambira, head of the All-Burma Monks Alliance, has been twice detained by police because of his public criticism of the government and for unilaterally re-opening sealed monasteries. Muslims routinely experience strict controls on a wide range of religious activities, as well as government-sponsored societal violence.

The Rohingya Muslim minority, in particular, is subject to systematic discrimination and a forced relocation program that has produced thousands of refugees. In ethnic minority areas, where low-intensity conflict has been waged for decades, the Burmese military forcibly promotes Buddhism and targets Christian religious groups for intimidation, forced labor, rape, and destruction of religious sites. Such tactics continued in the past year, particularly in Kachin and northern Shan states, where a large military operation began in the past reporting period. A 2008 regulation continues essentially to ban independent ―house church‖ religious venues throughout the country and Protestant religious leaders in Rangoon have been pressured to sign pledges to stop meeting in unapproved venues.

President Obama is scheduled for a Southeast Asia three-country tour from November 17-20, 2012 that includes Burma (Myanmar) and meetings with President Thein Sein and opposition leader Aung San Suu Kyi.

In light of Aung Suu Kyi's recent visit to the U.S., discussions about democratic reforms in Burma are underway. Burma's government has taken modest steps toward democratization by releasing hundreds of political prisoners, relaxing media censorship, and permitting Aung San Suu Kyi and the National League for Democracy to participate in the political process. 

The U.S. must continue to aggressively identify and underscore other atrocities that threaten future peace and stability, including the cessation of violence against the Kachin, Rohingya, and Chin people. We ask President Obama to highlight these concerns during his upcoming trip to Burma.

Burma stands at a critical turning point but additional reforms must still take place. As Aung Sang Suu Kyi recently said, “The world need[s] to understand that Myanmar is just at the beginning of the road to democracy, and that its present Constitution does not make the road smooth.”

In light of Aung Suu Kyi's recent visit to the U.S., discussions about democratic reforms in Burma are underway. Burma's government has taken modest steps toward democratization by releasing hundreds of political prisoners, relaxing media censorship, and permitting Aung San Suu Kyi and the National League for Democracy to participate in the political process. However, the U.S. must continue to aggressively identify and underscore other atrocities that threaten future peace and stability. Burma stands at a critical turning point but additional reforms must still take place. As Aung Sang Suu Kyi recently said, “The world need[s] to understand that Myanmar is just at the beginning of the road to democracy, and that its present Constitution does not make the road smooth.”

As the U.S. continues to work closely with the Burmese government on reforms, we must ensure that legitimate ethnic and democracy leaders are included in negotiations. Comprehensive and effective dialogue cannot be conducted without these leaders. Moreover, the U.S. must be careful to take no action that could be interpreted as endorsement of any misconduct or human rights lapses by the Burmese government or President Thein Sein, particularly while the Burmese government is still dominated by the military with a very brutal past.

Serious political dialogue within the framework of a robust peace process must take place to resolve the ongoing conflicts among Burma's ethnic and religious nationalities. The plight of the Kachin is often overlooked by the international community and humanitarian conditions are seriously deteriorating in Kachin State and Kachin refugee camps. Since the Burma Army broke the ceasefire agreement in Kachin State in June 2011, at least 70,000 civilians have been displaced from their villages. The atrocities committed against the Kachin by the Burma Army may amount to war crimes or crimes against humanity and should be thoroughly investigated and prosecuted as the evidence warrants. We urgently recommend you call for a withdrawal of Burmese troops and the establishment of meaningful political dialogue and a peace process that will result in a political solution for the conflict in Kachin State.

Violence by the Burma Army against the Rohingya Muslims in Rakhine State also continues with impunity and the Burmese government has failed to end what increasingly appears to be a campaign to forcibly displace thousands of Rohingya. Moreover, recent reports indicate how Burmese security forces are complicit with Rakhine Buddhists in carrying out brutal attacks against the Rohingya people. Within the past few weeks alone, thousands of homes in Rakhine State have been destroyed, hundreds of people slaughtered, and over 100,000 displaced. Indeed, now is the time to ensure the plight of the vulnerable Rohingya are not forgotten and stress that this crisis against Burma's Muslim population will threaten future democracy measures.

In the immediate future, humanitarian aid for both the Rohingya and Kachin is desperately needed. The U.S. must call for unhindered access for aid to all victims of violence, regardless of religion or race, in Rakhine and Kachin States. United Nation agencies and international nongovernmental organizations should be granted unrestricted access to the affected areas. The U.S. should not ignore state-sponsored persecution of these ethnic and religious minorities, especially during a high-profile Presidential visit, and indeed raise these ongoing issues with the highest levels of the Burmese government as roadblocks to true peace and progress in a democratic and free Burma. 

Violence against Chin Christians also deserves U.S. attention and escalation to the highest levels of the Burmese government. Chin is the poorest state in all of Burma and, for several decades, Chin communities have suffered institutionalized discrimination on the basis of both ethnicity and religion which has led to thousands of Chin refugees fleeing to neighboring India. Previously, successive military regimes viewed Christianity as a threat to homogenous national identity within Burma. However, Burmese nationalist resentment and discrimination continues against the Chin. Religious freedom and human rights atrocities have long been utilized against the Chin and include forced labor and conversion, torture, rape, restrictions on construction of Christian infrastructure, violations of peaceful religious assembly, and threats of intimidation and harassment of pastors and missionaries. We must see an end to attacks on churches and civilians. Additionally, the Burma Army uses rape against ethnic and religious minorities, including the Chin, and the U.S. must call for an end to this violence against the vulnerable. 

Burma still has a very long road ahead and the U.S. must continue to advocate for the full inclusion of ethnic and religious groups within Burmese society and within the political process. President Obama, your visit to Burma signifies our developing bilateral relationship and desire to encourage U.S. business investment in the country. With the additional credibility and validation that a Presidential visit gives to the Burmese government, specific reform agenda items should be on the table, including the cessation of violence against the Kachin, Rohingya, and Chin people. We urge you to ensure these minority groups, among others, are engaged in meaningful political dialogues and have fair opportunities for participation in the political process.

We look forward to hearing an update about your meetings in Burma and the progress of these discussions with the Burmese government.

ARU, BTF-USA, and ERC Appeals President Barak Obama to Demand Myanmar Government to Immediately End the Plights of Rohingya, and to Fully Cooperate with the International Community with Transparency

Arakan Rohingya Union (ARU), Burma Task Force USA, and The European Rohingya Council urgently appeal to President Barak Obama to address the ongoing ethnic cleansing of the Rohingya ethnic minority in Burma. We urge him to play an active role to help reach a long-term and durable solution to the current crisis, and to bring peace, stability, security, and communal harmony in Arakan state. President Obama must use his personal as well as the influence of the US Government and demand that President Thein Sein and the Myanmar Government officials must cooperate with the international community with utmost transparency. President Obama must unequivocally demand the Burmese Government to:

1. Repeal the 1982 Citizenship Law, dismantle the color-coded citizenship scheme, and reinstate the bona fide citizenship of the Rohingya ethnic minority.

2. Not to be the party to the violence in Arakan. Immediately stop violation of all the basic human rights of the Rohingya people by the Burmese police, Nasaka, and Lon Htein forces.

3. Adhere to the principle of honesty and integrity, and honor the memorandum signed by Organization of Islamic Conferences (OIC) and the Burmese Government for operation of OIC humanitarian aid office for the all affected people in Arakan.

4. Not to adopt segregation/apartheid policy in Arakan, allow the internally displaced Rohingya families to return to their homes and properties, and facilitate integration of the Rakhine and Rohingya communities for the long term and peaceful co-existence.

5. Stop collecting household data in Rohingya villages after each time violence breaks out and Rohingya families leave the village seeking refuge elsewhere. Myanmar officials must not force and physically abuse Rohingya people to use the term “Bengali” instead of Rohingya in paperwork.

6. Allow an independent international commission of inquiry, international monitoring teams and relief organizations in all townships in Arakan.

We caution the international community not to let Thein Sein's government blackmail it emotionally with the threat of reversal or derailment of democratic reform in Burma. President Thein Sein and his deputies are well aware of the consequences of the derailment. The Burmese Government and its forces with the Rakhine elements must not be allowed to use the “democratic reform” as a tool to legitimize its gruesome atrocities and serious violation of human rights against Rohingya ethnic minority in Arakan.



CAIR Asks U.S President to Address Attacks on Myanmar Muslims During Visit


WASHINGTON, America's largest Muslim civil liberties and advocacy organization today called on President Obama to use his upcoming visit to Myanmar (formerly Burma) to address the systematic persecution of that nation's Rohingya Muslim minority.

The Washington-based Council on American-Islamic Relations (CAIR) says the Rohingya people are denied citizenship and land rights, despite having lived in Myanmar for centuries. Hundreds of Rohingya have been killed and thousands displaced by what appears to be systematic ethnic-cleansing backed by elements of the Myanmar government.

According to a Reuters news agency investigation: "The wave of attacks was organized, central-government military sources told Reuters. They were led by Rakhine nationalists tied to a powerful political party in the state, incited by Buddhist monks, and, some witnesses said, abetted at times by local security forces."

Government Forces Targeting Rohingya Muslims here 

In a letter to President Obama, CAIR National Executive Director Nihad Awad wrote:

"I congratulate you on your recent re-election and look forward to the strengthening of our nation's economy and security. A significant part of America's strength is derived from our defense of human rights worldwide.

"I therefore respectfully request that you speak out clearly and forcefully in defense of the human rights and physical security of Rohingya Muslims during your upcoming visit to Myanmar.

"While we all welcome Myanmar's recent move to democracy, our nation must not turn a blind eye to what is one of the worst examples of human rights violations in recent history.

"I urge you to make any upgrade in the status of Myanmar as a trading or political partner contingent on its government's willingness to recognize the rights of Rohingya Muslims and to protect them and their property from harm."

In August, CAIR sent letters to the governments of Myanmar and Bangladesh seeking protection for Rohingya Muslims who faced a renewed wave of ethnic and religious persecution.

Reuters Special Report | Witnesses tell of organized killings of Myanmar Muslims



(Reuters) - On a hot Sunday night in a remote Myanmar village, Tun Naing punched his wife and unleashed hell.

She wanted rice for their three children. He said they couldn't afford it. Apartheid-like restrictions had prevented Muslims like Tun Naing from working for Buddhists here in Rakhine State along Myanmar's western border, costing the 38-year-old metalworker his job.

The couple screamed at each other. Tun Naing threw another punch. Neighbors joined in the row.

The commotion stirred up ethnic Rakhine Buddhists in the next village, who began shouting anti-Muslim slurs. Relations between the two communities were already so tense that six soldiers were stationed nearby. Tun Naing's village was soon besieged by hundreds of Rakhines. And Myanmar was plunged into a week of sectarian violence that by official count claimed 89 lives, its worst in decades.

The unrest exposes the dark side of Myanmar's historic opening: an unleashing of ethnic hatred that was suppressed during 49 years of military rule.

It is a crucial test for an 18-month-old reformist government in one of Asia's most ethnically diverse countries. Jailed dissidents have been released, a free election held and censorship lifted in a democratic transition so seamless that U.S. President Barack Obama is scheduled to make a congratulatory visit on November 19.

State media have largely absolved authorities of any role in the October unrest, depicting it mostly as spontaneous eruptions of violence that often ended with Muslims burning their own homes.

But a Reuters investigation paints a more troubling picture: The wave of attacks was organized, central-government military sources told Reuters. They were led by Rakhine nationalists tied to a powerful political party in the state, incited by Buddhist monks, and, some witnesses said, abetted at times by local security forces.

A leader in the regional party, the Rakhine Nationalities Development Party, denied it had a role in organizing the assaults but conceded the possible involvement of grass-roots supporters. "When the mob rises with very hot ethnic nationalism, it is very difficult to stop them," Oo Hla Saw told Reuters in an interview.

Two townships - Pauktaw and Kyaukphyu - saw the near-total expulsion of long-established Muslim populations, in what could amount to ethnic cleansing. One village saw a massacre of dozens of Muslims, among them 21 women.

Interviews with government officials, military and police, political leaders and dozens of Buddhists and Muslims across a vast conflict zone suggest Myanmar is entering a more violent phase of persecution of its 800,000 mostly stateless Rohingya, a Muslim minority in an overwhelmingly Buddhist country.

CALLED "BENGALIS"

Rohingya have lived for generations in Rakhine State, where postcard-perfect valleys sweep down to a mangrove-fringed coastline. But Rakhines and other Burmese view them as illegal immigrants from neighboring Bangladesh who deserve neither rights nor sympathy. Rakhines reject the term "Rohingya" as a modern invention, referring to them instead as "Bengali" or "kalar" - a pejorative Burmese word for Muslims or people of South Asian descent.

October's attacks marked an acceleration of violence against the Rohingya. An earlier wave of unrest in June killed at least 80 people. Afterwards, the Rakhine State government imposed a policy of segregating Muslim communities from Buddhists across an area roughly the size of Switzerland.

More than 97 percent of the 36,394 people who have fled the latest violence are Muslims, according to official statistics. Many now live in camps, joining 75,000 mostly Rohingya displaced in June. Others have set sail for Bangladesh, Thailand and Malaysia on rickety boats, two of which have reportedly capsized, with as many as 150 people believed drowned.

There is no evidence to suggest the Buddhist-dominated national government endorsed the violence. But it appears to have anticipated trouble, stationing troops between Muslim and Buddhist villages a month ago, following rumors of attacks.

"This is racism," said Shwe Hle Maung, 43, chief of Paik Thay, where impoverished Muslim families cram into thatched homes without electricity. "The government can resolve this if it wants to in five minutes. But they are doing nothing."

The Rakhine violence is also a test for Nobel Peace Prize-winner Aung San Suu Kyi, now opposition leader in parliament, whose studied neutrality has failed to defuse tensions and risks undermining her image as a unifying moral force. Suu Kyi, a devout Buddhist, says she refuses to take sides.

At stake is the stability of one of Myanmar's most commercially strategic regions and the gold-rush of foreign investment that has come with an easing of Western economic sanctions. The United States and the European Union have suspended, not lifted, sanctions, and have made resolving ethnic conflicts a precondition for further rewards.

In Rakhine State, however, the conflict has spread, most recently to areas where Muslims have long lived peacefully with Buddhists, according to a reconstruction of the violence from October 21 through October 25.

In Paik Thay, the Buddhist Rakhine mobs hurled Molotov cocktails at wooden huts, while Tun Naing and his neighbors fled. Muhammad Amin, 62, said he was beaten with a metal pipe until his skull cracked. The initial violence ended after soldiers fired their guns into the air and police arrested a Rakhine.

The bloodshed was only beginning.

"WE HAD NO PROBLEMS BEFORE"

The next morning, Monday, October 22, hundreds of Rakhine men gathered on the southern outskirts of Mrauk-U, an ancient capital studded with Buddhist temples about 15 miles north of Paik Thay. Then they marched to Tha Yet Oak, a Muslim fishing village of about 1,100 people, and set alight its flimsy bamboo homes.

The Muslim villagers fled by boat to nearby Pa Rein village. The Rakhine mob followed, swelling to nearly 1,000, according to Kyin Sein Aung, 66, a Rakhine farmer from a neighboring Buddhist village.

He didn't recognize the mob; he described them as "outsiders" and said he suspected they came from Mrauk-U. Hundreds now poured across a stream separating the villages. Others came by boat. By noon, there were about 4,000 Rakhines, according to both Buddhist and Muslim villagers.

Four soldiers shot in the air to disperse the crowd but were easily overwhelmed, witnesses said. The Muslims fought back with spears and machetes, torching a rice mill and several Rakhine homes. Rakhines fired homemade guns.

Six Muslims were killed, including two women, said M.V. Kareem, 63, a Muslim elder in Pa Rein - a toll confirmed by the military. He and other villagers said they saw familiar faces and uniformed police in the angry crowd.

"I don't know why it started," said Kareem, who has friends in the Buddhist village. Buddhist farmer Kyin Sein Aung was baffled, too. For years, he worked in rice fields shoulder-to-shoulder with his Muslim neighbors. "We had no problems before."

Communities like Pa Rein had avoided the June violence. But new strains emerged with the subsequent segregation of Muslim and Buddhist villages, a draconian order imposed by the Rakhine State government. Intended to prevent more violence, it backfired.

Impoverished Muslim villagers could no longer buy rice and other supplies in Buddhist towns. Transgressors were sometimes beaten with sticks or fists to warn others, according to people interviewed in six Muslim villages. Fishing nets were confiscated.

Desperation grew, with rice stocks dwindling as the monsoon peaked in October. Some Muslim villagers stole rice from Buddhist farmers, further stoking anger, said farmer Kyin Sein Aung.

By 4:30 p.m. that same Monday, several thousand Rakhines were massed outside Sam Ba Le, a village in neighboring Minbya township. By now, a pattern was emerging.

Rakhines flanked the village, hurling Molotov cocktails and firing homemade guns, said a village elder. Muslims fought back, sometimes with spears or machetes, but were overpowered. Government troops shot rounds into the air. By the time the crowd left Sam Ba Le at 6 p.m., one Muslim man had been killed and two-thirds of its 331 homes razed.

As night fell, the townships of Mrauk-U and Minbya imposed 7 p.m. to 5 a.m. curfews. But worse was to come.

"RAKHINES WILL DRINK KALAR BLOOD"

Tuesday began with a massacre. Reuters reporters visited dozens of villages in Rakhine State. But there was only one where their entry was barred by soldiers and police: the remote, riverside community of Yin Thei, in the shadow of the Chin mountains.

What happened there suggested a bolder and better organized mob, aided by incompetent or complicit police.

By 7 a.m. on Tuesday, hundreds of Rakhine arrived on boats to surround Yin Thei, said a resident contacted by telephone. By late afternoon, the Muslim villagers were fending off waves of attacks. The resident said children, including two of his young cousins, were killed by sword-wielding Rakhines. Most houses were burned down.

Musi Dula, a Muslim farmer from a nearby village, said he heard gunfire at about 5 p.m. A Yin Thei villager telephoned Musi Dula's neighbours and said police were shooting at them. Another farmer nervously told Reuters how he watched from afar as police opened fire from the village's western edge, also at about 5 p.m.

The official death toll is five Rakhines and 51 Muslims killed at Yin Thei, including 21 Muslim women, said a senior police officer in Naypyitaw, the new capital of Myanmar. He denied security forces opened fire or abetted the mobs. The Yin Thei resident put the toll higher, saying 62 people were buried in small graves of about 10 bodies each.

As Yin Thei burned, the last of nearly 4,000 Rohingya Muslims were fleeing the large port town of Pauktaw, in a dramatic exodus by sea that had begun five days earlier.

Tensions had simmered since October 12, when four Rohingya fishermen were killed off Pauktaw, said a military source. Afterwards, local authorities had ordered Rohingya to stay in their own villages for their safety. Men couldn't work in town, and few dared to go fishing.

"The government gave us food but it wasn't enough," said Num Marot, 48. "We didn't dare stay."

Pauktaw's Rohingya began cramming into boats for the two-hour voyage to the state capital, Sittwe. Num Marot's new home would be a tarpaulin tent in a squalid camp already packed with tens of thousands of people displaced by the June violence.

About 30 minutes after the last boat pushed out to sea, the two Rohingya neighborhoods in Pauktaw were set ablaze, witnesses said. All 335 homes were destroyed. The charred and roofless frame of a once-busy mosque is marked with graffiti: "Rakhines will drink kalar blood," it reads, using the slur for Muslims.

Kay Aye, deputy chairman of Pauktaw township, insists Rohingya set alight their own homes and blames the communal problems on the Muslim population's doubling in 10 years. "Muslims want all people to become Muslims. That's the Muslim problem," he said. "Most of the Muslims here are uneducated, so they tend to be ruder than Rakhines."

Tuesday night fell. Soon a new inferno began in Kyaukphyu, a sleepy port town 65 miles southeast of Sittwe with strategic significance: gas and oil pipelines lead from this township across Myanmar to China's energy-hungry northwest.

So far, the violence had targeted Rohingya Muslims. About a fifth of Kyaukphyu town's 24,000 people are Muslims, and many of them are Kaman. The Kaman are recognized as one of Myanmar's 135 official ethnic groups; they usually hold citizenship and can be hard to tell apart from Rakhine Buddhists.

Most Kyaukphyu Muslims lived in East Pikesake, a neighborhood wedged between Rakhine communities and the jade-green waters of the Bay of Bengal.

Relations between the two communities had began to unravel after the June violence. The destruction of Buddhist temples by mobs in Muslim Bangladesh in early October further stoked the animosity.

The first fire began in East Pikesake on Tuesday evening, and soon dozens of houses, Rakhine and Muslim, were ablaze. The streets around the Old Village Jamae Mosque, one of East Pikesake's two mosques, became the front line in pitched battles between the two communities.

Rakhines fought with swords, iron rods and traditional Rakhine spears. The Muslims had jinglees - long darts made from sharpened bicycle spokes or fish hooks, which are fitted with plastic streamers and shot from catapults.

With the sea behind them, Pikesake's Muslims were cut off from escape by Rakhine crowds so large that the security forces, which numbered about 80 police and 100 soldiers, were overwhelmed, said Police Lieutenant Myint Khin, Kyaukphyu's station commander. "We couldn't control them," he said.

Police fired tear gas and rubber bullets to disperse Muslim and Rakhine mobs, said Police Lieutenant Myint Khin. The military fired live rounds, said a source in the security forces, but evidently not into the crowd. Staff at Kyaukphyu hospital told Reuters they treated injuries from blades, jinglees and fire, but none from bullets.

"TAUGHT THEM A LESSON"

The next morning, the rest of East Pikesake went up in flames. Myint Hlaing, a local official, said the heat was "more intense than a crematorium." It singed the fronds of five-story-high palm trees.

Rakhine men had begun pouring in from surrounding villages. Unpublished video shot by an amateur cameraman shows young men in red bandanas entering the town in convoys of tractors. They helped to terrorize Muslims living elsewhere in Kyaukphyu, according to Muslim and Rakhine witnesses. Police Lieutenant Myint Khin said the security forces were too overstretched to stop them.

Men with swords pulled Susu, 39, and her husband Than Twa, 48, from a house in west Kyaukphyu. "They cut him here and here and here," said Susu, chopping at her arms and legs. She recognised many of her attackers: They were neighbours, she said. Susu ran off to find some soldiers, who escorted her back to rescue her husband. He was dead.

Only two forces could give the mob pause. The first was the national military, which scattered crowds by shooting in the air. The second was Rakhine Buddhist officials such as Myint Hlaing.

Some officials joined the mob, said local Muslims, but others confronted it. Facing cries of "Kill the kalar protector!" Myint Hlaing, 68, pleaded with angry Rakhines outside Kaman Muslim homes in his neighbourhood. "If we hadn't protected the Kamans, their houses would be destroyed and the people dead," he said.

By mid-morning, the military began evacuating Muslims by bus to a guarded refugee camp outside town.

Back in Pikesake, which was still burning, the Muslims had only one exit: the sea. A flotilla of fishing boats was preparing to leave its blazing shores.

"People swam out to the boats but were chased down and stabbed before they got there," said Abdulloh, 35, a Rohingya fisherman. Xanabibi, 46, a Kaman woman, said she watched from a boat as three Rakhine men with swords set upon a Muslim teenager. "I watched them ... cut up his body into four pieces," she said.

Rakhine Buddhists claim they witnessed atrocities, too. Myint Hlaing said he saw a Muslim on one departing boat hold aloft a severed Rakhine head.

By mid-afternoon, at least 80 boats, many overloaded with 130 or more people, had set sail for Sittwe, said witnesses. An additional 1,700 or more Muslims ended up at a squalid, military-guarded camp outside Kyaukphyu.

The official statistics tell of a lopsided battle at Kyaukphyu. Of the 11 dead, nine were Muslims. Nearly all of the 891 houses destroyed belonged to Muslims; nearly all of the 5,301 people displaced were Muslims. Four of Kyaukphyu's five mosques were destroyed.

A prominent Rakhine businessman, who requested anonymity, showed little sympathy for his former neighbours. "The majority taught them a lesson," he said.

"HOT ETHNIC NATIONALISM"

The last spasm of violence took place at Kyauktaw, a town north of the state capital, Sittwe. At that point, the military shot into the crowd - and, for the first time, killed the Buddhists it had long been accused of siding with.

Soldiers opened fire to prevent Rakhine villagers on two boats from storming a Rohingya Muslim community, said Aung Kyaw Min, a 28-year-old Rakhine from Taung Bwe with a bullet in his leg. "I don't know why the military shot at us," he said. Two people died and 10 were wounded, villagers said.

In a separate incident the same day, security forces shot at Rakhines on Kyauktaw's outskirts, killing two and wounding four, a witness told Reuters.

The shootings seemed to send a message to the mobs. The violence stopped that day.

The senior police officer in Naypyitaw acknowledged that police were forced to fire at both Muslims and Rakhines in their attempts to subdue large crowds.

The official death toll from the October violence now stood at 89. The real toll could be higher. The extent of the killing at Yin Thei village remains unclear. Reports persist that scores of Muslims fleeing Pauktaw drowned after Rakhines rammed their boat. Nearly 4,700 homes were destroyed in 42 villages.

In a statement that Thursday, President Thein Sein warned that the "persons and organizations" behind the Rakhine State violence would be exposed and prosecuted. The mobs were well-organized and led by core instigators, some of whom moved village to village, military sources told Reuters.

In Kyaukphyu, however, police have so far arrested only seven people - six of them for looting. In Mrauk-U township, where most killings occurred, only 14 people have been arrested, said the military intelligence officer. The apparent impunity of the instigators is sending a chilling message to Muslim communities across Myanmar.

The intelligence officer, who has direct knowledge of the state's security operations, identified the suspected ringleaders as Rakhine extremists with ties to the Rakhine Nationalities Development Party, or RNDP, which was set up to contest Myanmar's 2010 general election. He didn't name any suspects. Buddhist monks stoked the unrest with anti-Muslim rhetoric, he added.

RNDP Secretary-General Oo Hla Saw denied that his party organized any mobs. But he acknowledged the possible involvement of supporters, low-level officials and "moderate monks who become radical when they think about Muslims."

Oo Hla Saw blamed local authorities for failing to heed rumors of impending violence, and Islamist radicals for inflaming tensions. For many Rakhines, he adds, the term Rohingya has jihadist overtones associated with the "Mujahid," autonomy-seeking rebels in northern Rakhine State from 1949 to 1961, who called themselves ethnic Rohingya. (Independent historians say the rebels did popularize the term "Rohingya," but cite a few references to it since the 18th century.)

Even today, Oo Hla Saw said, the Rohingya want "to set up an autonomous Islamic community. They are systematically scheming to do that."

Most Rohingya struggle simply to get by. A 2010 survey by the French group Action Against Hunger found a malnutrition rate of 20 percent, far above the emergency threshold set by the World Health Organization.

Many arrived as laborers from Bangladesh under British rule in the 19th century - grounds the government now uses to deny them citizenship. Rohingya were effectively rendered stateless under the 1982 Citizenship Law, which excluded them from the list of indigenous ethnic groups. Officials refer to them as Bengalis. Most Rohingya found it hard to apply for naturalized citizenship, since they couldn't speak Burmese or prove long-term residence.

Monks, symbols of democracy during 2007 protests against military rule, have helped fuel the outrage against Muslims. A week before the violence erupted, monks led nationwide protests against plans by the Organisation of Islamic Cooperation (OIC), the world's biggest Islamic body, to set up a liaison office in Rakhine State.

An anti-OIC rally in Sittwe on October 15 "angered Muslims here," conceded Nyar Nar, 32, one of the Rakhine monks who led it. He regards Muslims as foreign invaders. "As monks, we have morality and ethics," he said. "But if outsiders come to occupy our land, then we will take up swords to protect it."

In some parts of the state, the mood is celebratory. "This is the best time because there are no Muslims here," said Zaw Min Oo, a Rakhine shoe seller in Pauktaw township. Nearly 95 percent of a 20,000-strong Muslim community there is now gone.

The peace might be short-lived. The state's clumsy attempts at segregation helped create the conditions for the October violence. Further segregation - including the confining of tens of thousands of Muslims in seething camps - could spark more violence. Curfews remain in force across much of Rakhine State.

In Kyaukphyu town, starving dogs sniff through the ashes while municipal workers heave scrap metal into a truck. The only Muslim left in town is Ngwe Shin, an old woman suffering from mental illness. She can often be found near the market, shuffling past vandalized or shuttered homes.

Supporting Human Rights in Burma | Samantha Power



Yesterday’s announcement that President Obama will become the first U.S. President to visit Burma marks an historic step in the United States’ engagement with Burma. In the past year, since President Obama first noted “flickers of progress” in Burma – and since Secretary Clinton became the most senior U.S. official to visit since 1955 – we have seen continued progress on the road to democracy. Several opposition political parties have been permitted to register legally for the first time and their members – including Aung San Suu Kyi – have been elected to parliament. Restrictions on the press have been eased. Legislation has been enacted to expand the rights of workers to form labor unions, and to outlaw forced labor. The government has signed an action plan aimed at ridding its army of child soldiers; it has pledged to join the Extractive Industries Transparency Initiative (EITI) to help ensure that Burma’s natural wealth is not squandered to corruption; and it has announced fragile ceasefires in several longstanding ethnic conflicts. 

Seeing these signs of progress, we have responded in kind, with specific steps to recognize the government’s efforts and encourage further reform. We have eased sanctions, appointed our first ambassador in 22 years, and opened a USAID mission. At the same time, we have also updated sanctions authorities that allow us to target those who interfere with the peace process or the transition to democracy, and we created a ground-breaking framework for responsible investment from the United States that encourages transparency and oversight. 

We are clear-eyed about the challenges that Burma faces. The peril faced by the stateless Rohingya population in Rakhine State is particularly urgent, and we have joined the international community in expressing deep concern about recent violence that has left hundreds dead, displaced over 110,000, and destroyed thousands of homes. There is much work to be done to foster peace and reconciliation in other ethnic conflicts, develop the justice sector, and cultivate the free press and robust civil society that are the checks and balances needed in any stable democracy. But we also see an historic opportunity both to help Burma lock in the progress that it has made so far—so that it becomes irreversible—and to meet the many challenges in front of it. In May 2011, as the Arab Spring took hold, the President noted that America’s interests are served when ordinary people are empowered to chart their own political and economic futures. And to governments, he made a promise: if you take the risks that reform entails, you will have the full support of the United States. 

Last month, as part of our effort to fulfill that promise, the Obama administration held the first-ever official bilateral dialogue on human rights with the Government of Burma. Led by Michael Posner, Assistant Secretary of State for Democracy Human Rights and Labor, the purpose was to initiate a new channel between our two countries to discuss challenges ahead – a high-level exchange on urgent and delicate issues that would have been unthinkable a year ago. Our delegation included not only Posner, Ambassador Derek Mitchell, and other State Department officials, but also senior officials from the White House, the Vice President’s office, USAID, the Department of Homeland Security, and the Department of Defense, including both civilian officials and uniformed military. The delegation included experts on labor rights and economic development, rule of law and political reform, ethnic conflict and reconciliation, land-mine removal, and criminal justice. Our hosts included senior advisors to President Thein Sein and ministers and senior officials from across the Burmese government and military. Aung San Suu Kyi attended in her capacity as a member of parliament and the chair of a new legislative committee on the rule of law. 

Before the official dialogue began, the U.S. delegation spent three days in Rangoon meeting with former political prisoners, ethnic minority leaders, labor advocates, LGBT organizations (who said that this was the first time any government had ever invited them to meet together), and other members of Burma’s nascent civil society. When we sat down for our official dialogue in Naypyidaw, we were able to convey the concerns raised in these meetings to our counterparts, while also stressing the importance of their building an inclusive reform dialogue that would seek inputs from Burmese civil society. 

The U.S. government engages with many countries around the world in official dialogues on human rights. While these discussions are often a useful forum for diplomacy, it is fair to say that these conversations can sometimes be stilted, characterized by predictable presentations rather than a spontaneous back-and-forth in which uncertainty can be expressed. The U.S.-Burma dialogue was unusually high-energy and candid. 

We both recognized the need to empower reformers in and out of government, protect against backsliding, and ensure the broader Burmese public feels the changes afoot. One of the most challenging aspects of reform is enlisting the country’s military, which governed the country through authoritarian rule for five decades. U.S. Army Lieutenant General Francis Wiercinski drew on his own experiences to make a powerful case to senior officials from the Burmese Defense Ministry that national security is helped rather than hindered by transparency and independent monitoring, and by compliance with international humanitarian law and human rights law. The discussions, which emphasized areas where commitments to reform are necessary – including on child soldiers, forced labor, and in conflict areas – underscored that the gradual process of normalizing our military-to-military relationship will hinge on progress on human rights. 

Many of the issues that we discussed in detail will likely feature in the President’s upcoming trip to Burma. These included: 
Prisoners of conscience. The release of more than 700 political prisoners in the last year has been unprecedented. But as Secretary Clinton has made clear, for the United States even one prisoner of conscience is too many, and the State Department has passed along a list of those we are concerned remain imprisoned. In addition, as one ex-prisoner put it, “we have been released, but we are not free.” The released prisoners have a huge amount to offer a democratic Burma, but, as we noted, the government will need to lift outstanding travel and other restrictions in order for them to participate fully in society. 
Political reforms. Reforms have begun to change the political landscape, particularly as parliament has become more inclusive, and as representatives are increasingly answerable to their constituents. But efforts to build civil society, make government ministries responsive to the public, and create a more inclusive political process have just begun. In particular, the central government needs to tackle the challenge of ensuring that any reforms that are made by the parliament and central government are felt at the local level and especially in Burma’s border areas where the majority of the country’s ethnic minorities reside. 
Rule of law. The parliament and the executive branch have tackled part of an ambitious agenda for remaking Burma's law and legal institutions. But the judicial branch remains the least developed of Burma's political institutions. Judicial reform, repealing outdated and restrictive laws, educating citizens of their rights, creating a vibrant civil society to protect those rights, and remaking the legal system and the legal profession all are required to lay the foundation of rule of law in Burma, and all have a long way to go.
Peace and reconciliation. The challenge of ongoing ethnic and sectarian violence -- including in Shan State, Kachin State, and Rakhine State – remains an area of deep and on-going concern. If left unaddressed, it will undermine progress toward national reconciliation, stability, and lasting peace. Serious human rights abuses against civilians in several regions continue, including against women and children. Humanitarian access to hundreds of thousands of internally displaced persons remains a serious challenge and on-going crisis. The government and the ethnic nationalities need to work together urgently to find a path to lasting peace that addresses minority rights, deals with differences through dialogue not violence, heals the wounds of the past, and carries reforms forward. The situation in Rakhine State and the recent violence against the Rohingya and other Muslims last week only underscores the critical urgency of ensuring the safety and security of all individuals in the area, investigating all reports of violence and bringing those responsible to justice, according citizenship and full rights to the Rohingya, and bringing about economic opportunity for all local populations. 

Ultimately, Burma's reforms will succeed or fail based on the efforts of the Burmese people themselves. President Obama's policy approach has been to support reform and those championing it – an investment in Burma’s future that the President will personally reinforce later this month in Rangoon. Behind this investment is a commitment to helping the Burmese people see the promise that lasting reform holds for their country. As they take charge of their destiny, the American people stand ready to help.

Making Rohingya statelessness | Nay San Lwin


Burmese government records of Rohingya In his article, “A friend’s appeal to Burma”, published on 19 June 2012, Benedict Rogers noted that the first President of Burma, Sao Shwe Thaike, a Shan, said that “Muslims of Arakan certainly belong to the indigenous races of Burma. If they do not belong to the indigenous races, we also cannot be taken as indigenous races”. “The people living in Buthidaung and Maungdaw Townships are Rohingya, ethnic of Burma” said Burma’s first prime minister U Nu in a pubic speech on 25 September 1954 at 8 pm. “The Rohingya has the equal status of nationality with Kachin, Kayah, Karen, Mon, Rakhine and Shan” said the prime minister and minister for defense U Ba Swe at public gatherings in Buthidaung and Maungdaw Townships on 3 and 4 November 1959. “The people living in Mayu Frontier is ethnic Rohingya” included in the announcement of Frontiers Administration office under Prime Minister Office on 20 November 1961. Mayu Frontier is composed of Buthidaung, Maungdaw and Rathedaung Townships.

Broadcasting from radio program in the Rohingya language was relayed three times a week from the indigenous language programme of the official Burma Broadcasting Service in Rangoon, from 15 May 1961 to 30 October 1965. Myanma Encyclopedia Vol.9, page 89-90, published in 1964, concludes that population of 500,000 living in Mayu Frontier of Northern Arakan State 75% is Rohingya. “The majority people live in Buthidaung, Maungdaw and Rathedaung Townships are ethnic Rohingya and the minorities are Rakhine, Daingnet, Mro and Khami” wrote in Tatmataw Khit Yay journal Vol.12, No.6 printed on 18 July 1961 and Vol. 12, No.9 printed on 8 August 1961.

In his speech on 8 July 1961, the Army Deputy Commander-in-Chief Brigadier General Aung Gyi said, “The people living in Mayu Frontier are Rohingya. Pakistan (now Bangladesh) is located in west of Mayu Frontier and Muslims are living there. The people living in west are called Pakistani and the people living here are called Rohingya. This is not the only border that has same people on both sides, border with China, India and Thailand also have the same phenomenon. For example: Lisu, Ei-Kaw, La-Wa live in Kachin State and same people live in China. Also Shan people can be found in China as Tai. The ethnics Mon, Karen and Malay are also living in Thailand. In India-Burma border Chin, Li-Shaw and Naga are living. These people are living in Burma as ethnics and living in India as well”.

The Rangoon University Rohingya Students Association was one of the many ethnic student associations that functioned from 1959 to 1961 under the registration numbers 113/99 December 1959 and 7/60 September 1960 respectively. In High School Geography textbook, printed in 1978, where scattered living regions of national races of Burma is shown on page 86, Northern Arakan is marked as ‘Rohingya region’.

Rohingya elites/MPs before and after independence of Burma

After the separation of Burma from India in 1935, the “Di-Archy” system was replaced by a ruling system called “91 Taa-na” (Departments administration). In that system there were 132 seats in the governing body and a total of 132 members were elected from various communal backgrounds. In this election, Mr. Ghani Markan, a Rohingya MP from Buthidaung and Maungdaw constituency, was elected. Point to be noted here that Mr. Ghani Markan was from the Community of “Burmese national” category and they (Rohingya) represented the Burmese national and not the Indian or any other group.

The General Election for Constituent Assembly in 1947 was organized just before the independence, mainly by the participation of General Aung San. This time, Buthidaung and Maungdaw had two separate constituencies. U Abdul Ghaffar for Buthidaung and U Sultan Ahmed for Maungdaw were elected.

U Abul Bashar for Buthidaung, U Sultan Ahmed and Daw Aye Nyunt for Maungdaw and U Abdul Ghaffar for Upper house were elected in 1951 election. U Ezhar Miah and U Abul Bashar for Buthidaung, U Sultan Ahmed and U Abul Khair for Maungdaw, U Sultan Mahmood for Buthidaung North and U Abdul Ghaffar for Upper house were elected in 1956. U Sultan Mahmood and U Abul Bashar for Buthidaung, U Rashid and U Abul Khair for Maungdaw and U Abdu Suban for Upper house were elected in 1961. By then the Rohingya community were involved more actively in politics. For the first time, one of the Rohingya elected member became a cabinet minister of Prime Minister U Nu’s government. He was U Sultan Mahmood, and in charge for the ministry of Education and Health. U Abdul Ghaffar and U Abul Bashar, elected members of Buthidaung became the Parliamentary Secretaries.

Even in the era of U Ne Win, the Rohingya exercised voting and representing rights in the Pyithu Hluttaw (National Assembly) Election and in the election of different levels of Pyithu (National) Council. Likewise, many Rohingya dignitaries were endorsed in the Burma Socialist Programme Party (BSPP) and some of them held higher positions as well. U Abul Hussein and Dr. Abdur Rahim were elected in 1974 from Buthidaung and Maungdaw.

Rohingya have been subjected to the discriminatory measure initiated in 1978 by the then BSPP and local authority of Rakhine community. They started to take the initiative to deprive the fundamental rights of Rohingya community and since then the Rohingya were marginalized from the Pyithu Hluttaw Election. U Tun Aung Kyaw aka Abdul Hai, was the only Rohingya representative elected in 1978 election from Maungdaw, but none from Buthidaung. The Rohingya were excluded from participating in the Pyithu Hluttaw elections in 1982 and 1986. However, some Rohingya were seen at lower levels of Pyithu Council of the BSPP.

In 1990 multi party general election, Rohingya exercised the voting and representing rights again. U Kyaw Min, U Tin Maung, U Chit Lwin and U Fazal Ahmed from National Democratic Party for Human Rights (NDPH) were elected from Buthidaung and Maungdaw constituencies. Later U Kyaw Min became a member of Committee Representing People’s Parliament (CRPP).

Making Rohingya stateless

Rohingya people used to have National Registration Cards (NRC) like everyone else in the country. Upon introduction of discriminatory policies on Rohingya by Ne Win in 1970s, the NRCs were taken away by various measures. Numerous check-points were set up to block Rohingya’s travel and to confiscate their IDs. Nagamin (the Dragon) operation in 1977-78 was skillfully crafted to drive out all Rohingya from Burma. It produced about 250,000 refugees that fled to neighboring Bangladesh. However, most of the fleeing refugees were returned to their original dwelling places, so the plan was not quite successful for the Burmese regime. Although systematic discriminatory policies were in place and IDs and other government issued documents were seized by the government, Rohingya remained as citizens of Burma until 1982. The Citizenship Act promulgated in 1982 is the official document that striped off the citizenship of Rohingya.

Numerous forms of discriminations followed by the enactment of 1982 Citizenship Law and lives of Rohingya had become incomprehensible. Again, another operation was carried out in 1991 by the successive military regime and it produced about 300,000 refugees, but this time about 200,000 remained in Bangladesh, of which, 28,000 are recognized refugees by the UNHCR and the rest are scattered around the country and are not recognized as refugees.

In the meantime, the regime uses different methods to eliminate (force out) the Rohingya population for the region: confiscation of farmland, establishing Buddhist settlement on Rohingya’s land, force labor, restriction on movement, restriction on marriage, harassment, desecration of religious places, arbitrary taxation, extrajudicial killings, rapes, and the list goes on.

The new National Scrutiny Card was introduced in 1989 and Rohingya were not entitled to receive them as they have become non-citizen under the 1982 Citizenship Act. However, the authorities issued Temporary Scrutiny Card to all and promised twice in 2008 constitution referendum and 2010 election that National Scrutiny Card will soon be issued to all the Rohingyas. But the promises made to Rohingya were never honored.

In a recent parliament session, when some MPs raised the issue of Rohingya, the immigration minister U Khin Yee said that “there is no Rohingya in Burma”. The same was echoed by the director general of the population department at a later date. Although many Rohingya were members of National League for Democracy (NLD) in Buthidaung and Maungdaw Townships during 1990 election, now the vice chairman U Tin Oo and other high ranking officials of NLD are openly saying that there is no race called ‘Rohingya’ in Burma, which is an utter disregard for historical facts, human rights and democratic principle. NLD’s discriminatory policy on Rohingya is no less than that of the military regime.

There is no justice for Rohingya in Burma as racism is deeply rooted in Burmese society. Rohingyas are made scapegoats to justify their evil doings by both ultra-nationalist racists and the regime to divert public attention. As history cannot be deleted or altered, the truth needs to be revealed and justice needs to be established. It is the human rights defenders that need to work hard to establish justice and defend the rights of the unjustly persecuted.
